Gujarat HC adjourns poker matter until 17 Feb


The game of skill has faced several legal setbacks and the mind sport is becoming questionable of its lawful existence. Be it live or online poker, it is no different from chess that requires the same knowledge, skill, patience, and observance. Although, the country has progressed establishing the poker industry with numerous top pros hailing from different regions and promoting the game that is wrongly held as a game of chance.

Let’s rewind once again, a civil petition was filed by Indian Poker Association (IPA) in Gujarat to recognize poker as a game of skill. Comprising of Chief Justice Vikram Nath and Justice AJ Shastri, the country adjourned the IPA Secretary KN Suresh, Dominance Games Private Limited, Aman Chhabra and Hotel Ramada, Ahmedabad case of December 2017 order of the single bench of the Gujarat High Court.

Once again, a division bench of the High Court comprising of Chief Justice Nath and Shastri did not hear the appeals that were scheduled on 8 January 2020. Instead, the court adjourned the matter to 17th February 2020 and stated that the hearings of the case would be conducted on a day-to-day basis.

By now, there have been over 22 adjournments. In the month of March 2019, the pending matter was pushed to 20th June and prior to that, the court decided to shift the matter of 7th February to 14th February 2019. The ongoing dispute was driven once again to 19th December following another scheduled hearing on 8th January 2020.

This is not only a major stumbling block for the poker clubs but also the online and skill games industry. The High Court had also indicated that it would try to expedite the hearings and ensure early disposal of the appeal. Any decision upon the industry would have major implications on the skill-based game within the state of Gujarat as well as a wider consequence across the country.
